A&B Title Transfer

Reclamation and A&B executed the title transfer agreement and related agreements on January 8, 2021 transferring ownership from Reclamation to A&B of the federally owned facilities, interests, and lands associated with the water conveyance system within the North Side Pumping Division of the Minidoka Project. This title transfer was authorized under Title VIII, Subtitle A, Section 8003(a)(1) of the John D. Dingell Jr. Conservation, Management, and Recreation Act of March 12, 2019 (Pub. L. 116-9).

Reclamation and A&B began the title transfer process immediately after Pub. L. 116-9 was signed into law. Reclamation and A&B held an open house on December 4, 2019, to share information about the A&B Title Transfer. The open house was held at the Minidoka Fire Protection District, Heyburn Office, in the community room, located at 1120 21st St. in Heyburn, Idaho, from 6:00 to 8:00 pm. Written comments were accepted until January 4, 2020.

Reclamation in working with A&B Irrigation District provided the public with the opportunity to review the negotiated draft of the final title transfer agreement for 30 days beginning September 30, 2020. A 90 day congressional review occurred from September 24, 2020 through December 24, 2020.

Through development of the Minidoka Project, the United States held title to the irrigation facilities serving A&B water users and other lands, rights and facilities supporting A&B operations. Operations, maintenance, and care of the A&B facilities were transferred to A&B on March 1, 1966.
