Reclamation Notifies Public That Possession, Discharging of Fireworks on Federal Lands is Illegal

BISMARCK, N.D. -- The Bureau of Reclamation would like to notify the public that discharging and/or possession of "Fireworks" is illegal on all U.S. Bureau of Reclamation land as per the Code of Federal Regulations (43 CFR Part 423.30).

"The only exception to this rule is if an organized group such as a Cabin Owners Association wants to request a Special Use Permit to discharge fireworks," said Scott Hettinger, Outdoor Recreation Planner, DKAO. "In the permit, a person or persons would be responsible and required to have one location designated by authorizing official where the fireworks would be discharged. The group whose name is on the permit would have to have liability insurance and would be liable for all damages that might be caused by the discharging of fireworks."

There is a cost for administrating the permit of approximately $200 and applications for a permit must be submitted at least 30 days in advance.

Special Use Permits will not be considered if submitted after June 20, 2017, and will not be issued to individuals for personal use.

The discharging of fireworks is illegal on all Federal lands and has been for some time. People who disregard this rule on Federal lands may face fines and possible jail time.

Campfires in enclosed fire rings remain legal unless state or county burn bans are declared.
