Reclamation Sets Proposed Rule on Land Uses

The Bureau of Reclamation last week published a proposed rule in the Federal Register which revises how the agency administers public lands under its stewardship (43 CFR Part 429, Use of Reclamation Land, Facilities, and Waterbodies). The public is invited to review the rule and make comments.

The revised rule addresses, among other things, the types of uses that do and do not require a permit or lease and specifies who is authorized to issue them. The proposed rule also addresses and expands upon some of the filing processes, permit fees and terms that may affect activities such as commercial guiding and outfitting, commercial photography, organized sporting events, grazing, telecommunications and utilities, public gatherings, special events, and sand and gravel removal.

The revised rule also provides guidance on private exclusive use permits and leases that are issued by Reclamation, water districts, non-federal recreation partners and concessionaires for grazing, cabin sites, boat docks, boat clubs, church camps, gun or shooting clubs, and other uses.

The proposed rule was published in the Federal Register on July 18, 2007. The rule can be read online at http://www.access.gpo.gov/su_docs/fedreg/frcont07.html (look in the July 18, 2007 edition).

A 90-day comment period for the revised rule will close on October 16, 2007. Comments may be submitted on the Internet, by e-mail or by mail as outlined in the "Addresses" section of the proposed rule.
