Public Review and Comment Period for Amendatory Contracts with the Santa Clara Valley Water District and the San Benito County Water District

The Bureau of Reclamation has released for public review and comment proposed amendatory water service contracts with the Santa Clara Valley Water District (Santa Clara) and the San Benito County Water District (San Benito). Both of the amendatory contracts will provide for water service from and repayment of the reimbursable capital costs of the San Felipe Project, a feature of the Central Valley Project. The review and comment period begins Monday, October 23, 2006, and ends Friday, December 22, 2006.

Santa Clara's existing contract with Reclamation was dated June 7, 1977, and expires December 31, 2027. San Benito's existing contract with Reclamation was dated April 15, 1978, and expires February 29, 2028. The expiration date of each existing contract will remain the same. The Santa Clara contract provides for delivery of up to 152,500 acre-feet per year for municipal and industrial (M&I) and agricultural purposes. The San Benito contract provides for the delivery of up to 43,800 acre-feet per year for M&I and agricultural purposes.

The proposed amendatory contracts will update the terms and conditions of the existing contracts to be consistent with the Central Valley Project Improvement Act of 1992. The contracts will also provide for repayment consistent with Section 9(d) of the Reclamation Project Act of 1939.
